Apurando la separación de funciones: la transposición que mejora la competencia en los sectores energéticos
La Comisión Nacional de Competencia acaba de publicar dos informes relativos a la transposición del tercer paquete comunitario a la normativa española y también ha terciado, aunque con mucha menos virulencia que en el caso de la Comisión Nacional de Energía, en el tema clave de la separación jurídica y funcional del operador de transporte y de sistema en Red Eléctrica de España. La CNC considera que esta transposición de la Directiva 2009/73/CE en los dos anteproyectos de Ley mejora, en general, la regulación vigente desde el punto de vista de defensa de la competencia.
La CNC recuerda las opciones que establece la Directiva 2009/73 para la articulación del operador de transporte y de sistema: la primera (y la más adecuada desde un punto de vista estricto de competencia, aunque tampoco se haya recogido en los países de nuestro entorno) consiste en un modelo de separación jurídica y patrimonial total. Una segunda posibilidad que brinda la Directiva es el modelo de Gestor Independiente del Sistema (modelo ISO), en el que una entidad independiente se ocupa de gestionar las instalaciones de transporte de otros operadores. El tercer modelo el TSO requiere una serie de controles y limitaciones que impidan la influencia, control y conflictos de interés entre las funciones del operador de transporte sobre el de sistema.
En ese contexto, la CNC reconoce que la transposición en el sector eléctrico propone una separación de funciones más exigente entre el Operador del sistema y el Gestor de la Red de transporte.
Por otra parte, la CNC destaca la función relativa a la elaboración de metodologías de cálculo de los peajes de acceso en la parte correspondiente a los costes de transporte y distribución, atribuida a la Comisión Nacional de Energía (las primeras, actividades realizadas por Red Eléctrica de España y las segundas, por las distribuidoras).
La separación de actividades: clave en el éxito de la liberalización
En la misma línea, la CNC también apura el principio de separación de actividades (unbundling). Según el regulador de competencia, el Anteporyecto de Ley introduce mejoras dirigidas a garantizar la separación efectiva entre las actividades de red y las actividades de generación y suministro, derivadas de la transposición de la Directiva, que se centran en el establecimiento de limitaciones al ejercicio del control simultáneo en empresas generadoras o comercializadoras y en el operador del sistema.
En este sentido, la CNC resalta la fundamental importancia que para la competencia en este sector, y por tanto para el éxito de la liberalización llevada a cabo, tiene el que la separación funcional entre las actividades reguladas y no reguladas sea efectiva.
