La CNC mete en un problema al Ministerio de Industria y a los grandes consumidores eléctricos
Parece que el expediente de la Comisión Nacional de Competencia, abierto en forma de «coche escoba» al sector eléctrico, le puede reventar en las manos al propio Luis Berenguer, afectando al Ministerio de Industria. De hecho, estos días continuaba el torrente de declaraciones sobre las empresas del sector de hidrocarburos desde este organismo. Y, del mismo modo, se filtraba de forma selectiva desde la CNC, al diario «El Economista» el contenido de varios correos electrónicos relativos a las comunicaciones entre la patronal Unesa y AEGE, lo que ha generado un fuerte malestar en la propia Administración, donde piensan que la CNC está yendo demasiado lejos.
Algo que, además, puede desatar las más imprevisibles consecuencias, tanto en el proceso público a través de los medios de comunicación desplegado por los responsables de la Comisión Nacional de Competencia para soportar sus posiciones, como por el ejercicio de la defensa jurídica de las empresas sobre las que ha recaído el expediente de la CNC. De hecho, se ha conocido recientemente por distintos medios que el gabinete Garrigues ha sido contratado por UNESA para su defensa jurídica en este proceso.
Mientras tanto, crece la preocupación dentro del propio organismo relativa a la forma de incoar las sanciones, obviando documentos y pruebas contrarias a sus pretensiones iniciales. De hecho, el expediente de la CNC contenía información y documentación relativa a las admoniciones directas de la Administración, a través del entonces Secretario General de Energía, para instar a las empresas a promover condiciones ventajosas en la contratación de la electricidad para los grandes consumidores. De hecho en dicha documentación, la Secretaría General de Energía se situaba en el centro del proceso.
Así pues, el servicio de investigación de la CNC recoge en el expediente actas, registros, correos electrónicos y reuniones organizadas directamente, instadas o con conocimiento de la Secretaría General. Incluso, en algún caso, la Secretaría General de Energía se encargó de organizar una reunión con las empresas titulares de la tarifa G4. De hecho, incluso el Plan de Acción resultante elaborado tras los acuerdos con AEGE fue remitido a Industria, tal y como consta en el expediente. Industria habría promovido estos acuerdos para facilitar condiciones ventajosas a las empresas industriales con gran consumo de energía de cara a la liberalización y la finalización del sistema de tarifa regulada. Todos estos documentos han sido obviados en la decisión final del organismo que preside Luis Berenguer y han sido convenientemente expurgados de lo filtrado estos días a los medios.
La Comisión Nacional de Energía tampoco se escapa del posible revolcón de una tramitación poco pulcra y que, a la vez, está llevando a que la CNC redoble su ofensiva mediática de defensa en los medios para atrincherarse en sus posiciones. En efecto, el expediente que fue analizado por la CNE en el mes de mayo de 2010 a solicitud del área de investigación de la Comisión Nacional de Competencia fue resuelto sin adentrarse en el contenido de un anexo, dentro del pliego de concreción de hechos, en el que constaban todos los registros de estas reuniones, ninguneando estos documentos.
